Cellwand Communications’ application for #TAXI for taxi dispatch services was initially refused by the Trademark Office Examining Attorney based on an assertion that the mark was merely descriptive because it was simply a telephone number that can be dialed to call for a taxi.  Attorney Sokol showed that the mark was distinctive and used by consumers as a source identifier, which persuaded the Office to withdraw its refusal, and issue U.S. Registration No. 3,137,442 for #TAXI for providing a national dispatch brokerage service for taxicab and livery operations.
